These Terms of Use ("Terms", "Terms of Use") govern your access to and use of the Cadexa website, mobile application, services, features and related digital products (collectively, the "Services").

By accessing the Cadexa website, downloading the Cadexa application, creating an account, purchasing a plan, or using any Cadexa service, you agree to these Terms and our Privacy Policy.

If you do not agree with these Terms, please do not use the Services.

1. About Cadexa

Cadexa is an educational technology platform designed to assist National Cadet Corps (NCC) cadets and aspirants with examination preparation, revision, practice tests, previous-year questions, progress tracking and related educational resources.

Cadexa is an independent educational platform.

Unless expressly stated otherwise, Cadexa:

• is not a Government of India website;
• is not operated by the National Cadet Corps;
• is not operated by the Ministry of Defence;
• is not operated by any NCC Directorate, Group Headquarters or NCC unit; and
• does not represent itself as an official NCC authority.

References to NCC, its wings, ranks, certificates, subjects, syllabus or examination structure are made solely for educational and informational purposes.

2. Eligibility

You may use Cadexa only if you are legally capable of entering into a binding agreement under applicable law.

Cadexa is intended primarily for NCC cadets and aspirants, including junior cadets who may be below 18 years of age.

Where required by applicable law, consent or authorization from a parent or lawful guardian may be necessary for the use of certain features or processing of personal data.

If you are a parent or lawful guardian permitting a minor to use Cadexa, you agree to these Terms on behalf of the minor to the extent permitted by law.

3. Account Registration

Certain Cadexa features may require you to create an account.

You agree to:

• provide accurate information;
• keep your account information updated;
• maintain the confidentiality of your login credentials;
• not share your account with another person;
• immediately notify us of unauthorized access; and
• use the account only for lawful purposes.

You are responsible for activities conducted through your account unless you can demonstrate that such activity occurred without your authorization and despite reasonable precautions.

4. Use of the Cadexa Website

The Cadexa website may provide:

• information about Cadexa;
• application download links;
• pricing information;
• subscription information;
• frequently asked questions;
• privacy and legal policies;
• customer support information;
• product announcements;
• promotional information; and
• other information relating to Cadexa.

The website itself may not contain the complete learning content available in the Cadexa application.

The primary learning and examination-preparation services are provided through the Cadexa application.

5. App Download

The Cadexa Android application may be distributed through Google Play.

When downloading or installing the application, you may also be subject to Google's terms, policies and applicable Google Play rules.

Google Play independently manages the distribution of applications and, where applicable, payment processing, subscriptions, refunds and related services.

Cadexa is not responsible for interruptions, outages or technical problems affecting Google Play that are outside our reasonable control.

6. Educational Content

Cadexa may provide educational materials including:

• NCC subject material;
• lessons;
• notes;
• multiple-choice questions;
• descriptive questions;
• mock examinations;
• previous-year questions;
• practice tests;
• explanations;
• revision material;
• performance analytics; and
• other educational resources.

We make reasonable efforts to keep educational material accurate and useful.

However, Cadexa does not guarantee that:

• every question appearing in an actual NCC examination will be covered;
• a particular question will appear in an examination;
• use of Cadexa will result in passing an examination;
• a user will obtain a particular score or certificate; or
• examination patterns will remain unchanged.

Official NCC authorities, examination authorities and other competent authorities may change syllabi, examination patterns, eligibility requirements or procedures without notice.

Users should refer to official NCC communications wherever an official requirement is involved.

7. No Guarantee of Examination Results

Cadexa is a preparation and educational tool.

Cadexa does not guarantee examination success.

Individual results depend on several factors, including:

• preparation;
• attendance;
• personal effort;
• examination performance;
• examination difficulty;
• syllabus changes;
• eligibility;
• official examination rules; and
• other circumstances outside Cadexa's control.

Any statement suggesting improvement, preparation or performance should not be interpreted as a guarantee of a particular result.

8. Accuracy of Information

We attempt to maintain accurate and current information.

However, information relating to NCC:

• syllabus;
• examination pattern;
• certificates;
• training;
• eligibility;
• camp requirements;
• administrative procedures;
• ranks;
• organization; and
• other official matters

may change.

Where there is any conflict between Cadexa content and an official instruction issued by a competent authority, the applicable official instruction should be followed.

9. Paid Services

Certain Cadexa features may require payment.

Paid products may include, depending on the plans offered:

• individual courses;
• subject packages;
• examination packages;
• mock-test packages;
• annual access;
• multi-year access;
• subscriptions; or
• other digital services.

The exact products, prices, duration and benefits applicable to you will be displayed before purchase.

10. Pricing

All prices displayed by Cadexa will be stated in the applicable currency and may include applicable taxes where required.

Prices may change from time to time.

A price change will not normally affect a successfully completed purchase for the period already purchased, unless otherwise required by applicable law or the terms of the relevant subscription.

Promotional prices may be subject to additional conditions.

11. Payments

Payments for digital content or services purchased through the Cadexa Android application may be processed using Google Play Billing or another payment method permitted under applicable Google Play policies and Indian law.

Google Play currently requires Google Play Billing for many digital goods and services offered through Play-distributed applications, while certain alternative billing programs may be available in India subject to Google's requirements.

The payment method actually presented to you at checkout will govern the transaction.

12. Subscriptions

Where Cadexa offers subscriptions, the subscription page will specify:

• subscription price;
• duration;
• billing frequency;
• included services;
• renewal terms, if applicable;
• cancellation terms; and
• any applicable promotional period.

Subscription information will be presented before purchase.

Google Play requires subscription offers to clearly disclose material terms including price, billing cycle and renewal information.

13. One-Time or Fixed-Term Access

Some Cadexa products may provide access for a fixed period, for example:

• one year;
• three years; or
• another clearly specified period.

Unless expressly stated otherwise, purchasing a fixed-term plan does not mean that the user owns the underlying educational content.

The purchase grants a limited, non-transferable right to access the applicable digital services during the stated validity period.

14. Refunds and Cancellation

Refunds will be governed by:

• the terms displayed at the time of purchase;
• applicable Indian consumer law;
• Google Play's applicable refund policies, where Google Play processes the transaction; and
• any additional refund policy published by Cadexa.

Where a purchase is processed through Google Play, refund requests may be subject to Google's procedures and policies.

Cancellation of a subscription does not necessarily result in an immediate refund.

Unless applicable law or the relevant refund policy provides otherwise, cancellation may stop future renewals while access continues until the end of the already-paid period.

Google Play states that cancellation generally does not refund the current billing period, although developers may adopt a more flexible refund policy.

15. Account Suspension or Termination

Cadexa may suspend or terminate an account where reasonably necessary, including where a user:

• violates these Terms;
• engages in fraudulent activity;
• attempts unauthorized access;
• shares or redistributes paid content;
• copies or extracts protected content;
• abuses another user;
• interferes with the Services;
• attempts to circumvent access controls;
• uses automated systems to scrape the Services; or
• engages in unlawful activity.

Where appropriate, we may provide notice before termination.

Nothing in this section limits rights available to users under applicable law.

16. Prohibited Activities

You must not:

• copy Cadexa content without permission;
• reproduce or republish paid material;
• sell or sublicense your account;
• share paid access credentials;
• record, redistribute or commercially exploit protected content;
• reverse engineer the application except where legally permitted;
• interfere with application security;
• introduce malware;
• attempt unauthorized access;
• scrape large quantities of content;
• manipulate test results;
• use bots to create accounts;
• impersonate another user or organization;
• use Cadexa for unlawful purposes; or
• circumvent payment or subscription mechanisms.

17. Intellectual Property

All Cadexa intellectual property, including where applicable:

• name;
• logo;
• trademarks;
• software;
• application design;
• website design;
• graphics;
• illustrations;
• text;
• educational material;
• question banks;
• databases;
• test systems;
• user interface;
• source code;
• compiled code;
• animations;
• photographs; and
• other original material

is owned by or licensed to Cadexa and is protected under applicable intellectual-property laws.

Except as expressly permitted, you may not reproduce, modify, distribute, sell, publish or commercially exploit Cadexa intellectual property.

18. User-Generated Content

If Cadexa permits users to submit content such as:

• feedback;
• reviews;
• questions;
• suggestions;
• comments;
• reports; or
• other material,

you retain ownership of your lawful intellectual property in such content.

However, you grant Cadexa a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and display such content for operating, improving and promoting the Services, subject to our Privacy Policy and applicable law.

You must not submit content that:

• infringes another person's rights;
• contains unlawful material;
• contains malicious code;
• contains confidential information belonging to another person; or
• violates applicable law.

19. Third-Party Services

Cadexa may rely on third-party services such as:

• Google Play;
• Firebase;
• payment providers;
• analytics providers;
• cloud hosting providers;
• authentication providers;
• email providers; and
• other technology providers.

Your use of third-party services may also be subject to their respective terms and privacy policies.

Cadexa does not control the policies of independent third parties.

20. Availability of Services

We aim to keep Cadexa available and functional.

However, uninterrupted availability cannot be guaranteed.

The Services may occasionally be unavailable because of:

• maintenance;
• software updates;
• server problems;
• network failures;
• security incidents;
• third-party service failures;
• force majeure events; or
• circumstances beyond our reasonable control.

21. Updates

Cadexa may periodically update the application.

Updates may include:

• bug fixes;
• security improvements;
• new features;
• content updates;
• performance improvements;
• interface changes; or
• removal or modification of features.

Some updates may be necessary for continued use of the application.

22. Disclaimer

To the maximum extent permitted by applicable law, Cadexa provides the Services on an "as available" and "as is" basis.

We do not guarantee that:

• the Services will always be available;
• the application will be completely error-free;
• all information will always be current;
• every device will be compatible;
• examination results will improve; or
• any particular examination result will be achieved.

Nothing in these Terms excludes any consumer right or legal protection that cannot lawfully be excluded.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Cadexa shall not be liable for indirect, incidental, special or consequential losses arising from the use of the Services.

This includes, where legally permissible:

• loss of data;
• loss of opportunity;
• loss of anticipated examination results;
• interruption of service; or
• reliance on educational information.

Nothing in these Terms limits liability where such limitation is prohibited by law.

24. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Cadexa and its owners, employees, contractors and service providers from claims arising from:

• your unlawful use of the Services;
• your violation of these Terms;
• infringement of another person's rights by your actions; or
• fraudulent or abusive activity associated with your account.

25. Privacy

Your use of Cadexa is also governed by our Privacy Policy.

The Privacy Policy explains what personal information we collect, why we collect it, how we use it, how it may be shared, how it is protected and how users may exercise applicable rights.

26. Changes to These Terms

Cadexa may update these Terms periodically.

When material changes are made, we may provide appropriate notice through the website, application, email or another reasonable method.

The updated Terms will become effective on the date specified in the revised Terms.

Continued use of the Services after the effective date constitutes acceptance of the updated Terms, to the extent permitted by law.

27. Governing Law

These Terms shall be governed by the laws of India.

Subject to applicable consumer-protection and other mandatory laws, disputes relating to these Terms shall be subject to the jurisdiction of the competent courts at:

Shillong, Meghalaya, India

28. Consumer Rights

Nothing in these Terms is intended to remove, restrict or waive any statutory right available to a consumer under applicable Indian law.

The Consumer Protection (E-Commerce) Rules, 2020 apply to goods and services bought or sold through digital/electronic networks, including digital products.
